These terms apply to the work I do for clients and to the use of this website. They are written in plain language on purpose. If anything here is unclear, email me and I will explain it.
By engaging me for a project or using this site, you agree to these terms. If we have a signed proposal or statement of work that says something different, that document takes precedence over this page for that project.
Who I am
This site and the services described on it are operated by Elements Web Development LLC, a small agency providing WordPress website services. In these terms, “I” refers to the LLC and the person who runs it. You can reach me at info@elementsweb.dev.
What these terms cover
These terms cover the services described on this site: WordPress website builds, website consultations, website maintenance, the Website Care Plan, and monthly retainers. Each service has its own page describing what is included and what is not. Those descriptions are part of these terms.
Quotes, scope, and changes
Every project begins with a written quote or proposal. The quote states the deliverables, the timeline, the price, and what is excluded. That document defines the scope.
Work outside the agreed scope is quoted separately before it begins. This includes new pages, new features, design changes, and requests that arrive after the project has been approved. You will always see the cost before I do the work.
Payment terms
Website builds: 50% deposit to begin, 50% on final approval before launch. The deposit reserves your place in the schedule and is non-refundable once work has begun.
Consultations: Prepaid in full to reserve the time. Rescheduling is free with 24 hours’ notice. Less than 24 hours, the session is forfeited.
Website maintenance: Billed hourly at $100/hour in 30-minute increments. Invoices are due within 7 days. Work estimated above two hours is quoted in advance and requires approval.
Website Care Plan: Invoiced annually. Standard is $350/year, Elevated is $475/year. The fee is flat and renews twelve months from enrollment. Mid-year upgrades are prorated; downgrades take effect at the next renewal.
Monthly retainers: Billed monthly in advance. Light is $200/month, Standard is $450/month, Active is $850/month. Unused hours do not roll over. Additional hours are billed at $110/hour. Tier changes require 30 days’ notice.
Invoices unpaid after 30 days may result in work being paused. I will tell you before pausing anything.
What you provide
For a build to proceed, you provide final copy, logo files, images, and any content you want on the site. You confirm that you have the right to use everything you provide, including images, text, and trademarks. You are responsible for the accuracy of what you supply.
You also provide access to hosting, domain, and any third-party accounts needed for the project. You retain ownership of those accounts unless we agree otherwise in writing.
What I provide
I provide the design, development, configuration, and launch services described in the quote. I work with reasonable professional care and within the timeline stated in the quote, assuming content and feedback arrive on schedule.
Projects move at the speed of their content. If content is delayed, the timeline shifts. If a project stalls for more than 30 days because content has not arrived, I will pause the project and we will agree a restart date. Projects paused longer than 60 days may be re-quoted.
Ownership and licenses
Your content: You retain ownership of everything you provide, including text, images, logos, and trademarks.
The site: On final payment, you own the custom design, code, and content produced specifically for your project. Third-party components — themes, plugins, and libraries — remain under their own licenses, which are passed to you under those licensors’ terms.
Premium licenses: The core software licenses covered by the Care Plan are held on my account. They are not transferred to you. If you leave the Care Plan, you keep the site and start fresh with your own licenses.
Portfolio: I may display the completed site in my portfolio and discuss it in general terms, unless we agree otherwise in writing.
The 14-day bug-fix window
Every build includes a 14-day window after launch during which I fix defects in the work I delivered at no charge. This covers things that are broken because of how they were built. It does not cover new requests, content changes, or failures caused by third-party plugins, hosting, or services after launch.
After 14 days, fixes are covered by the Care Plan for routine updates, or billed hourly for one-off issues.
What is not included
Unless a quote or service page says otherwise, the following are not included in any service: copywriting and editing, logo design or brand identity work, premium stock photography, advanced SEO or content marketing, and emergency recovery from malware or a hack. These are available separately and quoted before work begins.
Third-party services
Your site depends on services I do not control: hosting, domain registration, email delivery, and the plugins and platforms the site uses. Their availability, pricing, policies, and security are outside my control. I will configure and recommend them where appropriate, but I am not responsible for outages, price changes, or policy changes from those providers.
Limitation of liability
To the maximum extent permitted by law, my total liability for any claim arising from a project is limited to the total fees you paid for that project. I am not liable for indirect, incidental, consequential, or lost-profit damages, or for losses caused by third-party services, compromised credentials, or events outside my reasonable control.
Nothing in these terms excludes liability that cannot lawfully be excluded.
Termination
Either of us may end a project with written notice. If you terminate, you pay for work completed up to that date, and the deposit is non-refundable. If I terminate, you pay for work completed and I will deliver whatever work in progress exists.
Care Plans and retainers may be cancelled with the notice periods stated on their service pages. Cancellation does not entitle you to a refund of fees already paid, except where required by law.
Governing law
These terms are governed by the laws of the State of Texas. Any dispute will be handled in the courts of Travis County, Texas, unless we agree otherwise in writing.
Changes to these terms
If these terms change, the updated version will be posted here with a new date at the top. Changes apply to future projects and renewals, not to work already underway under a signed quote.
